1. Acceptance of Terms

By accessing or using FNA App's financial planning platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, please do not use our Services. These Terms apply to all users — clients, financial strategists, and agency owners.

2. Description of Services

FNA App is a financial planning platform that connects clients with financial strategists. Our Services include:

• Financial needs assessment and goal-setting tools
• Personalized financial analysis and projection reports
• Secure connection with your assigned financial strategist
• Financial planning documents, calculators, and resources
• Training and onboarding modules for strategists and clients

3. User Accounts

3.1 Account Creation

Access to FNA App is either by signing up yourself or by an invitation. Some accounts are created directly by users choosing a paid subscription plan; others are created by authorized financial strategists or administrators on your behalf. You will receive a secure link to set your password — we never send passwords in plain text.

3.2 Account Security

You are responsible for keeping your login credentials confidential. You agree to notify us immediately at info@fna-app.com if you suspect unauthorized access to your account. We are not liable for losses resulting from your failure to protect your credentials.

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent or abusive activity, or remain inactive for an extended period. You may request account deletion at any time by contacting us.

4. User Responsibilities

By using FNA App, you agree to:

• Provide accurate, complete, and up-to-date information at all times
• Use the Services only for lawful purposes
• Not share your account credentials with anyone else
• Not attempt to access other users' data or circumvent security measures
• Not interfere with or disrupt the platform or its infrastructure
• Comply with all applicable federal, state, and local laws

5. Financial Advice Disclaimer

FNA App is a platform that facilitates communication between clients and financial strategists. The information, analysis, and projections provided through our platform are for informational and planning purposes only. They do not constitute:

• Investment advice or a recommendation to buy or sell any security
• Legal, tax, or accounting advice
• A guarantee of any financial outcome or investment return
• A fiduciary relationship between FNA App and you

Always ask for license details of the strategist before taking any advice. If you are not clear, ask the strategist to explain what he/she can advise legally.

6. Privacy and Data Protection

Your use of the Services is governed by our Privacy Policy, which explains what data we collect, who can access it, and how we protect it. By using our Services, you consent to our data practices as described in the Privacy Policy.

7. Payment Terms

Subscription fees for agency and strategist accounts are processed securely through Stripe. Clients do not pay FNA App directly — any fees you pay are governed by your separate agreement with your financial strategist or their agency.

Subscriptions renew automatically unless cancelled before the renewal date. Cancellations take effect at the end of the current billing period. We do not issue refunds for partial billing periods unless required by law.

8. Intellectual Property

All platform content, software, design, logos, and analytical tools are owned by FNA App and protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse engineer, or resell any part of the Services without our express written permission.

Your financial data remains yours. By submitting it to the platform, you grant FNA App a limited license to process and display it solely for the purpose of providing the Services to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FNA APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.

Our total liability to you for any and all claims arising from your use of the Services shall not exceed the total amount you paid to FNA App in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless FNA App and its officers, directors, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any applicable law or third-party rights.

11. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and update the "Last Updated" date at the top of this page. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in Collin County, Texas.
